Mister Fitness Model Quest 2009
This contract protects both you and SportsmenAsia and Axcest.
Please read carefully, print out, and sign.

1. By submitting the above form, I represent that I have read, understood and hereby agree to all of the terms of this agreement.
2. I certify that I am over the age of 18 years old and that I am eligible to enter this contest without having to seek any prior approval or authorization from any third-party organization, company and/or person.
3. I certify that the photos are of me and I have the right to use and submit them for the purpose of this contest.
4. I authorize SportsmenAsia and/or Axcest to use, change, edit and/or publish any of the materials provided by me as SportsmenAsia and/or Axcest see fit.
5. I agree that SportsmenAsia and Axcest shall have the right to reject any materials provided by me without assigning any reason whatsoever.
6. I agree that all materials provided shall become the property of SportsmenAsia and Axcest for perpetuity. As such, SportsmenAsia and Axcest shall have the absolute right to use the materials for commercial purposes or otherwise, and in any medium and for any channel, and on any website/s and/or publication/s as they see fit.
7. I irrevocably grant SportsmenAsia and Axcest the permission to treat my submitted materials as if they were in the public domain at their discretion.
8. I agree to waive any rights for me to inspect, edit, withdraw, and/or disapprove the edited materials, final product and/or that which will be published or displayed to the public.
9. I agree to indemnify and hold SportsmenAsia and Axcest free and harmless from any and all claims, damages and liabilities arising out of or in any manner related to any materials provided by me.
10. I understand and agree that SportsmenAsia and Axcest shall assume no liability whatsoever for any replies or any actions arising out of any replies to any photos and/or related discussion and/or communication posted on the SportsmenAsia.com, Axcest.com and/or other affiliate websites and/or publications.
11. I agree that SportsmenAsia, Axcest and/or its affiliates shall not be liable for any failure of performance, error, omission, monitoring or lack thereof, censorship or lack thereof, delay in operation or transmission, communications failure, libel, defamation, theft or destruction or unauthorized access to or use of the submitted materials, whether for breach of contract, tortuous behavior, civil action, criminal action, negligence and/or any other cause for action.
12. This agreement serves as the entire agreement between the parties and may be amended upon notice by SportsmenAsia and/or Axcest.
